To assert the separation of powers between the Executive and Legislative Branches of the Student Government Council – Modesto A. Maidique Campus

SECTION I. Short Title
This bill may be cited as the “Separation of Powers Act of 2010”

SECTION II. Elimination of Section 6.2 Finance Committee Composition of the Finance Code
Section 6.2 Finance Committee Composition
6.2.1 Membership

  1. The Finance Committee shall consist of six voting members plus the SGC Comptroller. Each member shall have one (1) vote. The committee will consist of the following:
    1. One graduate student representative.
    2. One lower division representative.
    3. One Representative at-Large.
    4. Three representatives from the remaining members of the SGC Council.

All representatives are nominated by the SGC President and Comptroller.

If a finance committee member has been removed, the President and Comptroller shall elect an alternate to replace outgoing voting member. The alternate will become a permanent-voting member.
The SGA Senior Accountant Manager, the VPSA and the SGC President shall serve in an advisory capacity to the Finance Committee, and shall have all rights of regular members, except he or she may not vote.
6.2.2 Eligibility, Appointment, and Removal from the Committee
The SGC President and Vice President are ineligible to be voting members of the committee.
Elected SGA Standing Council Officers, Governing Council, Project Directors, and their Assistants shall be ineligible to be members of the committee due to inherent conflicts of interest.
The terms of the Finance Committee and the Comptroller members shall be one (1) fiscal year.
Vacancies on the Committee shall be appointed by the President and Comptroller.

SECTION III. Specifying that only Senators shall serve on the Senate Finance Committee
Section 6.3 Finance Committee Duties and Responsibilities
6.3.1 Finance Committee
The Finance Committee shall be comprised of Finance Committee Chairperson, the SGC Comptroller and five additional students Senators appointed through a majority vote of the SGA Senate.
