In commemoration of the late FIU Student Jaclyn Elisse Torrealba

WHEREAS, The mission statement of the Student Government Council and its elected Senators states that it is “committed to providing and improving the overall student experience,” as well as “fostering student life, encouraging community involvement, and serving the common interest of the students”;

WHEREAS, Jaclyn Elisse Torrealba was a cheerleader, part of the dance team and several honor societies, having graduated in the top ten percent of her G. Holmes Braddock Senior High School class;

WHEREAS, Torrealba had just begun to take classes at Florida International University, with aims to become a Lawyer;

WHEREAS, Torrealba passed away on October 11, 2009, victim to a terrible act of violence;

THEREFORE BE IT RESOLVED, that the Student Government Council – Modesto A. Maidique Campus commemorates Jaclyn Elisse Torrealba and expresses condolences to her family and friends for her unexpected passing away.

Agenda Item: Amendment to the Senate Officers Selection Process

To Establish the Nomination Process of the Executive Cabinet within the Student Government Council – Modesto A. Maidique Campus

SECTION I.

This act may be cited as the “Executive Cabinet Reform Act of 2009”

SECTION II.

Article II. Executive Branch

Section 2.05 Executive Cabinet

(a)    The members of the Executive Cabinet shall be nominated by the President and Vice President and approved by a simple majority of the Senate.

(b)  The composition of the Executive Cabinet is determined by the President and Vice President. There shall be a permanent Chief of Staff, and Director of Student lobbying within the Cabinet. Cabinet positions may also include: Executive Assistant, Director of Student Lobbying, Athletics Coordinator, Student Advocate, Special Events Coordinator, and Communications Director.

(i)         New Cabinet positions shall be created by the President through a New Cabinet Position Proclamation, to be announced at the next Executive branch meeting and Senate meeting following the proclamation.

(ii)        The Proclamation creating the position shall detail the exact title, functions and duties of the position.

(iii)       When presenting a nominee for a position in the Executive Cabinet, an official Nomination Form containing the nominee’s name, email address, major, previous experience and expected graduation date must be submitted. Additionally, those nominees appointed by the President and being presented for approval by the Senate must be in attendance in the Senate meeting during which they will be considered. If there is a case in which a nominee cannot be in attendance, the President may speak on their behalf, by discretion of the Senate Speaker.

1)        The Nomination Form shall be prepared by the Clerk of Council.

2)        Each nominee must be presented and confirmed individually.

(c)     An Executive Cabinet member may be removed from his/her position with no less than a two-thirds vote by the Student Senate. The basis for removal of an Executive Cabinet member shall be malfeasance, misfeasance, and/or nonfeasance. An Executive Cabinet member may also be removed by the President, or a President’s designee.

Amendment to Absence Limits for Graduate School Senators

SECTION I.

This bill may be cited as the “Graduate Senators Absence Limit Exemption Act of 2009”

SECTION II.

Article VIII. Meetings and Absences

Section 8.02 Meetings

(a)    Senators or officers are not allowed to miss more than two (2) meetings in any semester (summer semester excluded).

(i)   A special case by case exemption shall be made for all graduate senators who for academic circumstances must be excused for more than two (2) senate meetings.

1) Graduate senators are defined as follows:

i) College of Law Senator

ii) College of Medicine Senator

iii) Graduate Divisional Senators

2) All graduate senators must notify the Speaker of the Senate and the Clerk of Council of the academic circumstance at hand by 2:00 p.m. on Monday.

3)  Each exemption must be approved on a case by case basis at the Speaker’s discretion in order for it to qualify for this exemption.

(b)   To be counted as present, Student Government Council members must be present for a majority of the meeting.

In Support of Unified Meetings Between the Modesto A. Maidique Campus and Biscayne Bay Campus Senates

WHEREAS, The purpose of the Student Government Association is to represent and address the concerns of the student body as a whole;

WHEREAS, The student body is comprised of students who attend the Modesto A. Maidique Campus, the Biscayne Bay Campus, the Engineering Campus and the Broward Pines Center;

WHEREAS, The Student Government Council at MMC has expressed interest in promoting and encouraging more unity and consensus between the MMC-SGC and the BBC-SGC;

WHEREAS, It is apparent that there are two different cultures at each campus, hence only someone from each corresponding campus would be a fair representative of that campus, thus two SG assemblies must remain;

WHEREAS, There are many issues which affect the entire student body on all campuses, and should therefore be discussed and decided upon as a whole;

WHEREAS, The report from the Student Government Consulting Group of the American Student Government Association recommends that a committee be formed constituted of senators from the legislatures of both campuses, separate from the Executive Branch controlled University-wide Council;

THEREFORE BE IT RESOLVED, That the Student Government Council – Modesto A. Maidique Senate pledges to coordinate with the Student Government Council – Biscayne Bay Campus Senate to convene in a joint forum on a bi-monthly basis, in person or via teleconference, to address issues preeminent to the University as a whole.
