Council Bill: To Establish the Rules, Legislation and Judiciary Committee of the Student Senate

Agenda Item: Amendment to the Standing Committees of the Student Government Council to establish the Rules, Legislation and Judiciary Committee of the Student Senate

Committee: Rules, Legislation and Judiciary Committee Date: September 28, 2009

To Establish the Rules, Legislation and Judiciary Committee of the Student Senate

Section 5.04 Academic Affairs Committee

(a)        The purpose of the Academic Affairs Committee (AAC) is to review and evaluate academic issues and make necessary recommendations that shall represent students’ views on issues.

(b)        Should the Senate undertake a program of faculty evaluations, the committee shall oversee this project.

(c)        This committee shall also oversee the operations and services of the Library.

Section 5.04 Rules, Legislation, & Judiciary Committee

(a)        The Rules, Legislation, & Judiciary Committee (RLJC) shall be comprised of up to six senators, and presided by a Committee Chairperson, and shall hereby be referred to as Rules Committee.

(b)        The Rules Committee is charged with the responsibility of preparing and submitting the protocols, formats and rules to allow for efficient working of the Senate and its committees.

(i)        The Rules Committee shall prepare and maintain a Senate Rules of Procedure and submit them for approval by the Senate.

1)         These Rules of Procedure shall be amended by the same procedure as the Student Government Statutes, but shall not be subject to Presidential veto.

2)         The Senate Rules of Procedure shall serve to detail internal procedures and policies of the Senate and shall not conflict with the Student Government Association Constitution and Statutes.

(ii)       Each session, the Rules Committee shall review the Senate Rules of Procedure, and submit recommendations, if necessary for the improvement of the document.

(c)        It is the responsibility of this committee to ensure all Legislations are maintained by the Clerk and the Speaker through bi-weekly legislation record reports detailing the bills, summaries, votes and executive approval.

(i)        Once legislation becomes law, it is the responsibility of the Rules Committee to update the SGC-MMC Statutes.

(ii)        Prior to the submission of legislation to the Senate, this committee shall have the power to review the legislation to ensure the legality, proper format, spelling, grammar, references and syntax.

1)      All legislation must be submitted to the Rules Committee the Thursday prior to the Senate meeting by 5: 00 PM during which the legislation will be considered.

2)      Legislation not submitted to the Rules Committee may still be considered for a Senate meeting with a 2/3 approval of the Senate.

(ii)        Following the approval of legislation by the Senate, this committee shall have the power to review the legislation to ensure the proper format, spelling, grammar, references and syntax.

1)         This review is to be done before submission of the legislation to the Speaker for consideration by the President.

(d)       The committee will verify that all legislation is approved by the President.

(f)        Upon the request of a simple majority of the Senate, the Rules Committee can prepare and provide a report for applicants to the Supreme Court.

(g)        The Committee, also by request of a simple majority of the Senate, can also review the performance of the Chief Justice and Associate Justices, to then submit a positive or negative report.

(i)       If the committee submits a negative report, it can be considered grounds for instigation of impeachment against a member of the judiciary, in accordance with the SGA Constitution.

1)         If the Chief Justice is impeached, the Vice President of the SGC-MMC shall preside over the trial.

(h)        The Rules Committee will work in coordination with the Supreme Court to suggest updates and amendments to the Student Government Association Constitution and Statutes.

(i)         All judicial hearing reports may be reviewed by this committee, ensuring the legislative oversight over the Chief Justice and Associate Justices.

(j)         All amendments to the Senate Rules of Procedure must be presented to the Rules, Legislation, & Judiciary Committee for its approval by a simple majority.

(i)        Once the committee approves the legislation, it shall be presented to the Senate by a member of the committee.

(ii)       The procedural legislation may be approved with a majority vote of the Senate.

(iii)       Shall a proposal be rejected by the Committee, and a Senator wish that the legislation be reconsidered by the Rules Committee, he/she must gain a majority vote of the SGC-MMC Senate. This is to be done with a ‘Motion to Reconsider Proposed Procedural Legislation’.

(iv)       If the Rules Committee does not approve a piece of legislation after reviewing it for the second time, the Senate may overturn the committee’s decision with a two-thirds vote of its members.

(k)        The Rules Committee will work with the Internal Affairs Committee and Speaker to ensure that all responsibilities of Senators are being carried out. In the case that the Senate finds a case of malfeasance, misfeasance or nonfeasance, the Rules Committee shall file a grievance to the judiciary.
